Am I being charged with a felony or a misdemeanor?

A good criminal defense starts as soon as a matter is being investigated.  If you have already been arrested or charged, we can still help.  We can access the court's online data base and docket to help you determine the exact nature of the criminal charge you are facing.

Most of our Pierce County and Tacoma criminal clients have a lot of questions when they first contact our offices.  But one of the first questions that frequently ask us when they first contact our offices is whether or not they are being charged with a felony. 

If you have been cited to appear in either Tacoma Municipal Court or Pierce County District Court for a criminal arraignment, you are either being charged with a misdemeanor or a gross misdemeanor, and NOT a felony.

The Tacoma Municipal Court and the Pierce County District Court do not have jurisdiction over felony cases.  This is how you know that you are being charged with a criminal misdemeanor if your arraignment is in one of these courts.   If you are charged with a misdemeanor, you are facing a maximum penalty of up to 90 days in jail and a $1,000 fine. 

If you are charged with a gross misdemeanor, you are facing a maximum penalty of up to 365 days in jail and a $5,000 fine.  Most misdemeanors, with a few exceptions for charges such as DUI, do not carry a mandatory jail sentence.
